Expunge your criminal record for free
Criminal record checks are required for a variety of reasons including employment, education and joining the military service. If you have a criminal conviction on your record, you may be able to expunge the conviction without the need to spend money hiring a lawyer to represent you. If you successfully expunge the conviction, then it will no longer be reflected on a criminal background check.
Instructions
1. Determine whether you are entitled to an expungement pursuant to the laws of the state where you were convicted. Many state court websites provide links to expungement statutes. You can also find state statutes at the library or at a law school library.
2. Prepare the proper form to file with the court. Many states have self-help websites or offices where you can download or pick up a form to use. If that is not an option, you can prepare your own motion to expunge your conviction. Use the copy of the judgment of conviction for the caption at the top of the document. In the body of the document, tell the court what you were convicted of, when you were convicted and explain why you feel you are entitled to have the conviction expunged. Sign the motion.
3. Prepare an order and any other documents required in your state. All documents should be captioned the same. The order should state that the court received your motion, reviewed the motion and grants the motion or sets it for a hearing. In some circumstances the expungement is automatic and the motion will be granted without a hearing. In other situations, the court will require a hearing.
4. Make a copy of the original judgment of conviction and attach it to the motion. Make several copies of all finished documents.
5. File the documents with the clerk of courts in the same court where you were originally convicted of the crime. Serve a copy of all documents on the prosecutor by hand delivery or mail.
6. Wait for the court to return the order. If a hearing is ordered, then attend it. Answer questions honestly and present any evidence you have that will indicate that you are a good candidate for expungement.
