A K-1 visa, also known as a fiance(e) visa, is a non-immigrant visa issued to the foreign fiance(e) of an American citizen by the U.S. Citizenship and Immigration Services (USCIS) allowing legal entrance into the United States for the purposes of getting married to the American spouse. As a K-1 visa is a non-immigrant visa, the foreign fiance(e) cannot legally work in the United States under this visa category unless he or she applies for a work permit. Also, K-1 visas are single-use visas, meaning the foreign fiance(e) cannot leave the United States and return to the United States under the same visa. An American citizen is required file a petition with the USCIS on behalf of the foreign fiance(e).
Instructions
The Cancelation Process
1. Go to the home page of the U.S. Department of State at usembassy.gov/ and locate the specific U.S. embassy, consulate or diplomatic Mission where the K-1 fiance(e) visa was issued.
2. Mail a notarized written request addressed to the issuing U.S. embassy, consulate or diplomatic mission, stating that you would like to cancel your petition for a fiance(e)/K-1 visa.
Given the seriousness of the request as well as the fact that your identity has to be verified before this request can be processed, requests sent via an electronic medium such as an e-mail or a fax will most likely be denied.
3. Wait to receive a written confirmation from the issuing issuing U.S. embassy, consulate, diplomatic mission or from the USCIS that the petition has been canceled.
Do not assume that the petition has been canceled until you have received a written confirmation. It is highly recommended that you keep this confirmation in a safe place.
